Debt review is a financial process — and, at key points, a legal one.
NVD’s current website identifies National Credit Act debt review applications as its key speciality. This page separates the debt counsellor’s role from the attorney/court process so clients know what they are instructing.
From a debt counsellor’s proposal to a legally effective order.
NVD’s published service list centres on the papers, service, filing, hearing and order — the procedural work that follows an instruction.
1. The debt-review position is identified
The starting point is the consumer’s actual status: whether a debt counsellor is assessing over-indebtedness, whether a rearrangement proposal exists, whether an application has already been issued, or whether an order is already in place.
2. The legal file is built around the correct forum
Debt-review matters may involve a Magistrates’ Court or, in certain circumstances, the National Consumer Tribunal. The forum and existing order matter because they determine the legal route available.
3. The application papers move through procedure
NVD’s published service scope includes drafting applications and affidavits, obtaining a case number and court date, serving relevant parties, filing papers, notices of set-down and personal court appearances.
4. The result is dealt with as an order, not a marketing promise
A legal representative can prepare and argue a matter, but cannot guarantee that a court or tribunal will grant a particular order. The website therefore avoids guaranteed-outcome language.
Start with the legal problem, not the label.
I have a debt counsellor and need the matter taken to court. What next?
The attorney needs the instruction pack and proposal details before the application can be prepared. Use the court-application enquiry and identify the court/region if known.
I already have a debt-review order but something is wrong with it.
Send the order details and explain the problem. Rescission or variation is not automatic and the available route depends on who made the order, what is alleged to be wrong, and the applicable procedural requirements.
Can an attorney simply “remove” debt review?
There is no universal one-click removal process. The correct approach depends on the consumer’s status, any existing order, the debt position and the legal requirements that apply. NVD should first assess the documents.
Does NVD work with debt counsellors?
Yes. NVD’s published service history is centred on debt-review court applications, and the 2026 Debt Review Awards legal category lists the firm among attorney nominees representing debt counsellors.
Have a debt-review matter that needs legal assessment?
Tell NVD whether you are a consumer, debt counsellor or other stakeholder, what stage the matter is at, and whether an order already exists.
